Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the LogoMint platform, including our website, applications, and all related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. Beta Disclaimer

LogoMint is currently in beta. The Service is provided on an "as-is" and "as-available" basis. Features, functionality, pricing, and credit allocations may change at any time without prior notice. We make no guarantees regarding uptime, reliability, or the continued availability of any specific feature during the beta period. Your use of the Service during beta is at your own discretion and risk.

3. Account Terms

• You must be at least 16 years of age to create an account and use the Service.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• Each individual may maintain only one account. Creating multiple accounts to circumvent credit limits or other restrictions is prohibited.
• You must provide accurate and complete information when creating your account and keep it up to date.
• You must notify us immediately if you suspect unauthorized access to your account.

4. The Service

LogoMint provides AI-powered tools for creating professional brand assets. The Service currently includes:

• Logo generation — AI-generated logo concepts in multiple variants (icon with text, icon only, and text only).
• Brand kits — Color palettes, typography recommendations, and design tokens derived from your logo.
• Business cards — Professional business card templates with live preview and print-ready downloads.
• Social media kits — Profile pictures, banners, and content templates for major social platforms.
• Media kits — Professional documents including letterheads, branded presentations, and press materials.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

5. Credits

LogoMint operates on a credit-based system:

• Each account receives a free weekly allowance of 10 credits, renewed automatically.
• Credits are consumed when you perform certain actions, such as generating logos, downloading SVG files, or creating social media kits.
• Unused credits do not roll over from one week to the next. Your balance resets to the weekly allowance at the start of each renewal period.
• Credits have no monetary value and cannot be exchanged, sold, transferred, or refunded.
• We reserve the right to adjust credit allocations, costs, and renewal schedules at any time, particularly during the beta period.

6. Intellectual Property

6.1 Your Content

You retain ownership of the logos, brand assets, and other content you generate through the Service. Upon generation, you are granted a perpetual, worldwide, royalty-free license to use, modify, and distribute the assets you create for any lawful purpose, including commercial use.

6.2 Service Improvement

LogoMint may use anonymized and aggregated data derived from your use of the Service to improve our algorithms, train models, and enhance the platform. This data will not identify you personally and will not include your generated logos or brand assets in any recognizable form.

6.3 LogoMint Property

The LogoMint name, logo, branding, website design, underlying technology, and all platform content (excluding user-generated content) are and remain the exclusive property of LogoMint. Nothing in these Terms grants you any right to use our trademarks, branding, or proprietary technology.

6.4 Trademark Responsibility

You are solely responsible for ensuring that the logos and brand assets you generate do not infringe upon existing trademarks, copyrights, or other intellectual property rights of third parties. LogoMint does not conduct trademark searches and makes no representations regarding the availability or registrability of any generated design.

7. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Create logos or brand assets that intentionally infringe upon the trademarks, copyrights, or intellectual property rights of others.
• Abuse, disrupt, or interfere with the operation of the platform, including attempting to overload servers or exploit vulnerabilities.
• Use automated tools, scripts, bots, or scrapers to access the Service or extract data without our express written consent.
• Create multiple accounts to circumvent credit limits, bans, or other restrictions.
• Resell, redistribute, or sublicense access to the Service itself.

We reserve the right to suspend or terminate your account if we determine, at our sole discretion, that you have violated these acceptable use provisions.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• LogoMint shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.
• Our total aggregate liability for any claims arising out of or related to your use of the Service shall not exceed the total amount you have paid to LogoMint in the twelve (12) months immediately preceding the claim.
• We do not guarantee that generated logos will be unique, original, or free from similarity to existing designs.

9. Termination

Either party may terminate this agreement at any time:

• You may delete your account at any time through your account settings or by contacting us.
• We may suspend or terminate your account at any time if you violate these Terms, if required by law, or if we discontinue the Service.

Upon termination, your right to use the Service ceases immediately. Your account data and generated content will be deleted in accordance with our Privacy Policy. Any content you have already downloaded prior to termination remains yours to use under the license granted in Section 6.1.

10. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service:

• Good faith negotiation: The parties shall first attempt to resolve the dispute through good faith negotiation for a period of at least thirty (30) days after written notice of the dispute.
• Binding arbitration: If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration administered by a mutually agreed-upon arbitration body. The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding.
• Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will provide at least thirty (30) days' notice by email or through a prominent notice on the platform before the updated Terms take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those changes. If you do not agree with the updated Terms, you must stop using the Service and delete your account.
